Publisher Description: English summary: Nils Jansen analyzes the motives of the present attempts to unify and codify the European law of obligations and property. He ascertains that these attempts are based partly on the search for a common juridical identity in Europe, and questions whether there is in fact a common European law based on a common understanding and shared fundamental principles. The only positive answer to this applies to the law of contracts, since large sections of the law of torts, of restitution and of property were formed only during the last two centuries when the legal systems of the different European nations developed largely independently of each other. Thus any attempt to integrate European private law must develop an adequate methodology for their project. In the last part of this work, the author provides outlines for an approach to this. German description: Ausgangspunkt der Untersuchung sind die gegenwartigen Bestrebungen der Vereinheitlichung und gegebenenfalls Kodifizierung des europaischen Vermogensrechts. Diese Bestrebungen lassen sich nicht allein mit marktbezogenen instrumentellen Erwagungen erklaren; sie sind vor allem auch Ausdruck eines zunehmend verbreiteten Bedurfnisses nach einer europaischen Identitat, die auch im Recht ihren Ausdruck finden soll. Angesichts der verbreiteten Uberzeugung, das europaische Recht lasse sich ohne weiteres in der Form deskriptiver 'Restatements' zusammenfuhren, untersucht Nils Jansen, inwieweit derartige Integrationsbestrebungen heute uberhaupt auf ein einheitliches europaisches Grundverstandnis des Privatrechts aufbauen konnen. Die Antwort fallt allerdings nur fur das Vertragsrecht positiv aus. Denn erhebliche Teile des Haftungsrechts, des Bereicherungsrechts und des Sachenrechts sind erst nach der nationalen Zersplitterung der europaischen Rechtstradition vor 200 Jahren und damit weitgehend unverbunden entstanden. Angesichts dessen stellt sich die Frage nach der Methode einer integrativ rechtsvereinheitlichenden Privatrechtsdogmatik; dazu werden zentrale Grundlinien herausgearbeitet. |
