Publisher Description:
The enforcement of intellectual property rights has been one of the most important and controversial issues for almost a decade now. This volume presents the conference contributions at a bilateral conference organized by the Institute for Intellectual Property, Competition and Media Law (IGEWeM) at the Technische Universitat Dresden and the Institute of Intellectual Property Law at the Uniwersytet Jagiellonski in Krakow, held on 9/10 October 2009 in Dresden. Discussing the impact of the Enforcement Directive on national law and proceedings as well as the question if the reinforced recognition of intellectual property rights has reached its limits, speakers focused on the Implementation of the Enforcement-Directive into Polish Law (Tischner), Interlocutory injunctions in IP Disputes under Polish Law (Targosz), the Enforcement of Personality Rights (Muller), the Compulsory License under Competition Law and under German Law (du Vall and Gotting), Defences in Trademark Litigation (Hanske) and Patent Litigation (Ozegalska-Trybalska) and the Dualism in German Patent law (Hetmank).
